Shipping & Delivery

Shipping Methods
Shipping is provided though the United States Postal Service and UPS. During checkout you will be prompted to select a shipping method. Each method states the lead time on the shipping (for example 3-5 day shipping takes approx. 3-5 business days). Special shipping is available upon request if different shipping method and or lead time are desired. Please feel free to contact us via telephone or by email at info@yorkhill.com ; please be sure to include your name, telephone number, and order number in your email.

Important Notes:

  • Items purchased with credit cards will be charged immediately and funds held until item ships or further notification is provided. 
  • Shipping times are from the date the order ships. 
  • Please be advised that when cost-effective, we may upgrade your shipping at no additional cost to you. 
  • Orders shipped via USPS are not eligible for claims. We are not responsible for items mis-delivered or damaged.

This Privacy Policy of Yorkhill (the “Policy”) is hereby made effective as of August 1, 2013, by YorkHill (“YorkHill” “Us” “We” or “Our”), and, without waiving or otherwise releasing any right or obligation under any prior privacy policy or similar document or agreement of any YorkHill program and/or affiliate, including but not limited to YorkHill.com, hereby amend and restate any such prior privacy policy.

By using or accessing YorkHill, you thereby (i) agree and acknowledge that you have read and understood this Policy, and (ii) acknowledge and consent to the learning, collection and use of your Personal Information (as hereinafter defined) as described in this Policy. If you do not agree with any portion of this Policy, you are prohibited from using or accessing YorkHill.

1.0 - General

When you open an account with YorkHill and use any YorkHill application, you will provide certain information to Us and, during your use of the application; YorkHill will learn, collect and use certain additional information about you for various purposes, as more fully set forth in this Policy.

Even though YorkHill will learn, collect and use information about you, YorkHill will not lease, sell, share or otherwise provide your Personal Information (as hereinafter defined) to any third party without your consent, except as provided herein.

2.0 – What We Obtain, Collect and Use

Beginning when you register for a YorkHill account, YorkHill will learn, collect and use certain personal data and information about you and, as you use any YorkHill accounts will continue to learn, collect and use additional personal data and information (all such personal data and information is collectively referred to herein as, “Personal Information”).

3.0 – Registration with YorkHill

In order to become a purchaser of YorkHill.com, you must provide us with Personal Information, including, without limitation, your name, email address, and billing and credit card information. Without providing Personal Information, you cannot create a YorkHill account. At the time of registration or when you choose to use certain YorkHill services, We may collect certain other Personal Information from you including, without limitation, demographic information, such as location, age or gender. YorkHill may request or collect Personal Information from you during any registration process which YorkHill may use to provide or improve YorkHill or may use as is otherwise provided herein. YorkHill may store Personal Information, and it may be included in databases owned and maintained by YorkHill’s affiliates, agents or service providers.

4.0 - Using YorkHill

When you use and interact with YorkHill, We also receive and store additional Personal Information, which information may or may not be personally identifying information. Such information includes, without limitation, your internet protocol address, browser types, domain name, and other statistical data involving your use of YorkHill and/or our services. Such information is collected passively using various technologies or may be provided by you through communications with YorkHill.

YorkHill uses “cookies.” A cookie is a piece of information that YorkHill gives to your computer when you access YorkHill. Cookies are used by Us to track your usage of YorkHill, trends on the usage of YorkHill and to improve YorkHill and analyze and assess changes to, successes and failures of YorkHill and portions thereof.

For security purposes and to ensure the availability of YorkHill, We also use software programs to monitor network traffic, to identify unauthorized attempts to upload or change information, or otherwise cause damage to YorkHill or Us.

Based on how the internet operates, when you visit YorkHill we automatically receive the uniform resource locator of the prior webpage that you were on and of the webpage where you go after YorkHill. We also receive the internet protocol address of your computer, the type of operating system and web browser you are using, your location, date and time of your access, pages viewed on YorkHill and other information related to your visit to YorkHill.

We also collect information when you interact with YorkHill’s customer service in order to assist you and to improve the operation of YorkHill.

5.0 - How We Use Your Personal Information

We use your Personal Information in connection with the operation, development and improvement of YorkHill, the operation and billing of your YorkHill account, and for other uses consistent with this Policy. We may use your Personal Information for any internal purpose, including, without limitation the development and operation of YorkHill and the development of additional services and products by Us or our affiliates, and to communicate with you regarding YorkHill, your account or other services or products offered by Us. Please be aware that you are responsible for the payment of any fees or costs incurred by you in connection with receipt of communications from Us, including data, internet, cellular carrier or other similar fees.

We recognize the importance of the privacy of its users and does not lease, sell, share or otherwise provide Personal Information to third parties, except as provided herein. We will not disclose or provide your Personal Information to any third party except:

  • as otherwise described in this Policy;
  • as otherwise required by law or to comply with legal process, including, but not limited to, civil and criminal subpoenas, court orders or other compulsory disclosures;
  • as reasonably necessary to respond to claims of a violation of the rights of third parties, whether or not the third party is a user, individual, entity or government agency;
  • for any internal purpose of YorkHill or Us, including, without limitation, to manage your YorkHill account, subscription and other billing purposes, to respond to your inquiries, to allow outside vendors to perform services required by YorkHill, and to otherwise manage and operate YorkHill and develop new services and products;
  • as reasonably necessary to enforce the Terms and Conditions of Service and Use of YorkHill (the “Terms and Conditions”);
  • as reasonably necessary to detect, prevent and address fraud and other illegal activity and to prevent death or imminent bodily harm; or
  • as reasonably necessary to protect the rights and property of Us or our officers, directors, shareholders, employees or agents.

We may provide aggregated anonymous data about the usage of YorkHill to third parties for purposes that we deem, in our sole discretion, to be appropriate, including, without limitation, to prospective advertisers or investors.

You acknowledge that any information that you provide to YorkHill to develop your Facebook page will be publicly displayed on your Facebook page when you elect to post and display such information there.

We may post and use any testimonials that you have provided about YorkHill, and We may post examples of content created through YorkHill, in connection with the marketing and promotion of YorkHill. Testimonials and other marketing, promotions and advertisements may include Personal Information (such as name and location) that you have provided to Us.

We may also disclose your Personal Information to a third party as part of a sale of the assets of Us, as the result of a change in control of the company, or in connection with an investment in Us by a third party. Any third party to which We transfer or sell Our assets will have the right to continue to use your Personal Information.

6.0 - Access to and Protection of Your Personal Information

You have a right to access, modify, correct and request that We internally delete any Personal Information provided to or obtained by YorkHill or Us. If you update, modify or correct any Personal Information, we may keep copies of your Personal Information prior to such update, modification or correction for uses provided for in this Policy. You may request internal deletion of your Personal Information at any time by contacting Us in the manner provided on YorkHill. We will endeavor to respond to your request in a timely manner. Please note, however that Personal Information you have published on Facebook may remain available even if you request that such information be internally deleted by Us.

Any Personal Information that you provide to Us will be protected in a commercially reasonable manner.

7.0 - Miscellaneous

We reserve the right to amend, restate or otherwise modify this Policy at any time without notice to you. As a user of YorkHill you are required, and hereby agree, to review the Policy frequently. Should We elect to amend, restate or otherwise modify this Policy in a material manner, We will post a notice of such material amendment, restatement or modification on YorkHill so that you may review the changes to the Policy. If you object to any such changes to the Policy, you may, as your sole right and remedy, close your YorkHill account. By continuing to use YorkHill after such notice has been posted on the YorkHill Facebook application, you thereby consent to any such changes to the Policy and agree to be bound by the then current version of this Policy.

In the event that the terms of this Policy conflict with or are inconsistent with any provision of the Terms and Conditions, the Terms and Conditions shall govern.

Any claim under this Policy or otherwise related to YorkHill or Us shall be governed by the laws of the State of California without regard to its conflict of law provisions, and shall be exclusively resolved by a state or federal court located in Orange County, California. You agree to submit to the personal jurisdiction of the courts located within Orange County, California, for the purpose of litigating all such claims.

If any provision of this Policy is found by a court of competent jurisdiction or arbitrator to be illegal, void, or unenforceable, the unenforceable provision will be modified so as to render it enforceable and effective to the maximum extent possible in order to effect the intention of the provision; and if a court or arbitrator finds the modified provision invalid, illegal, void or unenforceable, the validity, legality and enforceability of the remaining provisions of this Policy will not be affected in any way.

Returns & Replacements

Returning/Exchanging a Purchase:
If you aren't satisfied with a purchase for any reason, you can return/exchange the item(s) within 15 days for a replacement, store credit, or a refund of the purchase price (minus the shipping, handling, gift wrap, and other re-stocking charges). Product must be unused and in its original packaging.

To initiate a return/exchange, please contact customer service at info@yorkhill.com and request an RMA. Please include your order number, the reason for return, and whether you would like a store credit or a refund.

Pack items safely and securely for shipping. Ship the items to the address below with a courier of your choice, including a note with the RMA number, or a copy of your invoice.

Upon receipt of the return, YorkHill.com will inspect the order and issue an exchange, store credit, or refund for eligible items within 24-48 hours.

Please note: 

  • Once an item has been used, it is no longer eligible for a refund/exchange. 
  • All shipping charges must be paid by the customer. COD deliveries will be returned to the customer.

Payment, Pricing & Promotions

All orders are charged at the time the order is placed. If the charge is declined, we will hold all unshipped items. If the order has already shipped, you agree to provide YorkHill.com with an alternate card to charge the order to. Please refer to our terms and conditions for additional details and policies.

YorkHill.com makes every effort to ensure items are priced correctly. However, in the event an item is mispriced, we will either: (a) if an item's correct price is lower than our stated price, we will charge the lower amount and ship you the item; or (b) if an item's correct price is higher than our stated price, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation. Viewing Orders

Copies of your orders are available under your My Account dashboard. Simply click "Login" at the top of the site and login. All recent orders are listed under "Recent Orders". Additional details are available by clicking on "View Order" beside the order your wish to view. Guest customers may contact customer service at info@yorkhill.com or 1-877-341-0633 to receive a copy of your order.
